These Terms of Service ("Terms") govern your use of MoonQuist ("the App"), developed by Benedikt Terhechte ("we", "us", or "our"). By downloading or using the App, you agree to these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions.

The App, including its design, code, preset names, and all associated materials, is the intellectual property of Benedikt Terhechte and is protected by copyright and other applicable laws. All rights not expressly granted in these Terms are reserved.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
MoonQuist is designed to generate ambient noise for relaxation and focus. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to sleep disorders, tinnitus, or hearing loss.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App.
You are solely responsible for setting a safe listening volume. Prolonged exposure to loud audio can cause hearing damage. We recommend keeping the volume at a comfortable level, especially when using headphones or earbuds and when using the App near infants or children.
Your use of the App is also subject to Apple's standard licensed application end user license agreement (EULA) available at apple.com/legal. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall take precedence to the extent of the conflict.
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate this agreement by deleting the App from your device.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
